HIGHLIGHTS

A public hearing is being held for Council to consider the following bylaws: Comox OCP Amendment Bylaw 1685.11, Comox Zoning Amendment Bylaw 1850.46 and Comox Phased Development Agreement Authorization Bylaw 2024 :” Aspen-Hector, to designate land uses and rezone the subject properties to facilitate a multi-family and neighbourhood commercial development.

DETAILS

In general terms, the purpose of Comox OCP Amendment Bylaw 1685.11 is to amend the Residential Policies, policy 2.1.1.3(g) to exclude from the 4 storey apartment maximum the properties at 941 Aspen Rd, 2077 Hector Rd and 2123 Hector Rd (shown shaded on the maps); and to update Maps: 3 Parks, Trails and Open Space; 5, Road Network; and 7, Bicycle Network.

Only in relation to the 941 Aspen Rd and 2077 Hector Rd properties:

1. Comox OCP Amendment Bylaw 1685.11 is to designate land use and include within the Development Permit Areas (DPA) as follows:

• western portion of 941 Aspen as Residential: Low Rise Apartments, Townhouses and Ground Oriented Infill; and within DPA #3 General Multi-Family and #11 Wildlife Corridor;

• eastern portion of 941 Aspen as Mixed Use: Commercial—Residential; and within DPA #4 Mixed Use: Commercial— Residential and #11 Wildlife Corridor;

• 2077 Hector properties as Residential: Low Rise Apartments, Townhouses and Ground Oriented Infill; and within DPA #3 General Multi-Family; #7 Riparian Areas and #11 Wildlife Corridor.

2. Comox Zoning Amendment Bylaw 1850.46 is to rezone the properties to RM 6.1 Apartment, RM 6.2 Apartment and Townhouse and C7.1 Commercial Residential zones, in accordance with their new land use designations, as described above.

3. Comox Phased Development Agreement Authorization Bylaw 2024 (Aspen-Hector) is to authorize the Town of

Comox to enter into a phased development agreement under s. 516 of the Local Government Act with Highstreet Hector Road Development Ltd. Inc. No. BC13677778 (the owners of 941 Aspen and 2077 Hector properties). In addition to securing a $728,000 affordable housing contribution for the first phase of development, $100,000 playground amenity contribution, and commercial space for a child care facility, the Agreement will limit the Town’s ability to change proposed zoning for a term of 10 years from the date of bylaw adoption. The Phased Development Agreement may be assigned to any subsequent registered owner of the subject property only if the subsequent registered owner assumes all obligations in the agreement.

NOTE: Pursuant to section 516(5) of the Local Government Act (but subject to subsection (6)), if the “specified zoning bylaw provisions” specified in a phased development agreement are amended or repealed while the phased development agreement is in effect, those changes do not apply unless the owner agrees in writing. The “specified zoning bylaw provisions” are all those provisions of Comox Zoning Bylaw 1850 applicable to the subject property (including the provisions of the Comox Zoning Amendment Bylaw 1850.46).

Copies of proposed bylaws, as well as existing relevant reports and documents will be available for inspection at Town Hall, 1809 Beaufort Ave, Comox, between the hours of 8:30am to 4:30pm Monday through Friday (except Statutory Holidays) and at commencing on June 26, 2024, until 4:00pm on the public hearing date. AT THE PUBLIC HEARING all persons who believe that their interest in the property is affected by the proposed Bylaws will be afforded an opportunity to be heard in person, by their representatives or written submission on all matters contained in the proposed Bylaws.

WRITTEN SUBMISSIONS, send by mail or email, as long as the submission:

• Is received before 12:00pm on July 10, 2024

• Is addressed to Mayor and Council

• Identifies the bylaw under consideration in the subject line; and

• Includes the name and address of the person making the submission

Each person is solely responsible to ensure that their submission is received on time. The Town will not issue any acknowledgement of receipt of such submissions.

Written submissions, including any personal information, will be made public and provided to Council. Further information on the collection of information may be obtained from the Corporate Officer at Town Hall.
